1. Agreement
These Terms of Service govern your access to and use of AiraStay. By creating an account, listing a property, booking a stay, making a payment, sending a message, or otherwise using the platform, you agree to these Terms, our Privacy Policy, and any booking, payment, cancellation, refund, host, guest, verification, or safety rules shown on the platform.
2. Marketplace Role
AiraStay provides a technology platform that helps guests find and book accommodations from independent hosts, property owners, and property managers. Unless expressly stated otherwise, AiraStay does not own, control, inspect, manage, lease, or operate listed properties and is not a party to the separate accommodation arrangement between a guest and a host. Hosts are responsible for their listings, properties, pricing, availability, legality, safety, taxes, permits, and guest experience.
3. Eligibility and Accounts
- You must be at least 18 years old and legally able to enter contracts.
- You must provide accurate account, identity, payment, payout, and contact information.
- You are responsible for all activity under your account and must keep login credentials secure.
- We may suspend, restrict, or terminate accounts that violate these Terms, create risk, evade restrictions, or appear fraudulent.
4. Google Sign-In
If you use Google sign-in, you authorize us to receive the basic account information Google provides, such as your verified email address and profile name, so we can create or authenticate your AiraStay account. Your use of Google remains subject to Google's own terms and privacy practices.
5. Host Responsibilities
- Hosts must have the legal right to list, rent, manage, and provide access to each property.
- Listings must be truthful, current, complete, and not misleading.
- Hosts must disclose material rules, risks, restrictions, fees, cancellation terms, and property conditions.
- Hosts are responsible for property safety, cleanliness, habitability, utilities, check-in, guest access, local taxes, permits, licenses, and compliance with laws, estate rules, building rules, and community rules.
- Hosts must not list properties used for fraud, illegal occupancy, illegal surveillance, unsafe conditions, trafficking, exploitation, stolen property, money laundering, or any other unlawful purpose.
6. Guest Responsibilities
- Guests must provide accurate booking information and only book for lawful personal or authorized business use.
- Guests must follow house rules, occupancy limits, safety instructions, check-in and check-out times, and applicable law.
- Guests are responsible for damage, unauthorized guests, unlawful conduct, nuisance, fines, and losses caused by them or their invitees.
- Guests must not use properties for crime, parties where prohibited, commercial activity without permission, exploitation, weapons offences, drugs, fraud, harassment, trafficking, or other harmful conduct.
7. Bookings, Approval, Cancellations, and Refunds
A booking may require host approval. A pending booking is not confirmed until accepted under the platform flow. AiraStay may automatically cancel pending bookings that are not approved within the stated approval window. Guest and host cancellations, refunds, fees, and restrictions are handled under the cancellation and refund rules shown during booking and in the booking management flow. Payment-provider delays, chargebacks, fraud reviews, payout holds, and legal compliance reviews may affect settlement timing.
8. Payments and Payouts
Payments and payouts may be processed by third-party payment providers. You authorize us and our providers to process charges, refunds, commissions, service fees, taxes, payouts, reversals, and chargebacks connected with your use of the platform. Hosts are responsible for taxes and lawful payout information unless the platform expressly states otherwise.
9. Prohibited Conduct
You must not use AiraStay to commit, assist, hide, promote, or profit from illegal, abusive, unsafe, or fraudulent conduct, including:
- Fraud, identity misuse, fake listings, payment abuse, chargeback abuse, money laundering, or sanctions evasion.
- Violence, threats, harassment, discrimination, exploitation, trafficking, sexual misconduct, or child safety violations.
- Illegal drugs, weapons offences, stolen goods, illegal surveillance, hidden cameras, cyber abuse, or unauthorized access.
- Scraping, reverse engineering, spam, malware, automated abuse, security testing without permission, or interference with platform operations.
- False reviews, review manipulation, off-platform payment circumvention, or attempts to evade fees, rules, restrictions, or law enforcement.
10. Reporting, Investigations, and Cooperation
Users must promptly report safety incidents, fraud, illegal activity, property damage, or suspected abuse. We may investigate, preserve records, remove content, cancel bookings, restrict accounts, withhold payouts, notify affected users, and cooperate with law enforcement, regulators, courts, payment providers, insurers, or emergency responders where legally required or reasonably necessary to protect rights, safety, property, or the platform.
11. Reviews and Content
You are responsible for content you submit, including listings, images, messages, reviews, and responses. Content must be lawful, truthful, non-infringing, and not abusive. You grant AiraStay a non-exclusive, worldwide, royalty-free license to host, display, reproduce, adapt, and use submitted content to operate, market, secure, and improve the platform. We may remove content that violates these Terms or creates legal, safety, or trust risks.
12. Disclaimers
The platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, AiraStay disclaims warranties of merchantability, fitness for a particular purpose, uninterrupted availability, accuracy of listings, host conduct, guest conduct, property condition, or outcomes from using the service. We do not guarantee that any property, host, guest, review, or booking will meet your expectations or be free from risk.
13. Limitation of Liability
To the fullest extent permitted by law, AiraStay and its officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, lost profits, lost data, business interruption, personal arrangements, property issues, user conduct, third-party services, or events outside our reasonable control. Where liability cannot be excluded, our aggregate liability will be limited to the greater of the platform fees paid to AiraStay for the disputed booking or the minimum amount required by applicable law.
14. Indemnity
You agree to defend, indemnify, and hold harmless AiraStay and its officers, employees, contractors, and affiliates from claims, losses, liabilities, damages, penalties, costs, and expenses arising from your listings, bookings, property, conduct, content, breach of these Terms, violation of law, infringement of rights, tax obligations, or disputes with other users or third parties.
15. Termination
We may suspend or terminate access, remove listings, cancel bookings, restrict payouts, or take other action where we reasonably believe it is necessary for safety, fraud prevention, legal compliance, platform integrity, or enforcement of these Terms. You may stop using the service at any time, but outstanding obligations remain in effect.
16. Governing Law and Disputes
These Terms are governed by the laws of the Federal Republic of Nigeria, unless mandatory consumer protection law requires otherwise. The parties will first attempt to resolve disputes informally through support. If unresolved, disputes may be submitted to courts or other competent dispute-resolution forums in Nigeria, subject to applicable law.
17. Changes
We may update these Terms from time to time. Material changes will be posted on the platform. Continued use after an update means you accept the updated Terms.
